Civilian War Dead & the CWGC

Can anyone tell me the criteria for inclusion on the CWGC listings for civilian war dead? Do they have to be from a commonwealth country?

(I'm asking because my local military cemetery has a civilian casualty -who goes by the name of "Ernst Lagermark" who died by enemy action in 1940 and does not seem to appear on the lists. I was wondering if he might have been a german refugee or something and was, therefore ,not listed)
